Regulation 82 401 Certification Work Group

Regulation No. 82 is the 401 Certification Regulation. This regulation authorizes the Water Quality Control Division to certify, conditionally certify, or deny certification of federal licenses and permits in accordance with Section 401 of the Federal Clean Water Act. This regulation applies to certifications of permits issued by the US Army Corps of Engineers pursuant to Section 404 of the Clean Water Act, Federal Energy Regulatory Commission licenses for hydropower projects, and other federal permits which involve a discharge into waters of the state including permits issued by the EPA pursuant to Section 402 of the Federal Clean Water Act.

The Regulation No. 82 workgroup will review the current regulation and comments submitted in 2016 by various parties to consider proposed changes to the regulation or other process/policy changes.

In order to get a better handle on placement of documents and improve searchability, membership is requested to use the document naming convention explained in the document naming conventions guideline. If the submission does not follow the convention, the work group coordator will be responsible for renaming the document before sending the file(s) to be posted. All files must be saved as a *.pdf before sending it to the web contact for posting.
